Erick Rosales Rojo found a lost iPhone 3GS in a movie theater, but allegedly refused to return it unless the owner paid a ransom, reports TheSmokingGun.com

After learning about her daughter’s lost phone, mother Donna Barr called the phone number of the lost phone, and a man calling himself “Erick” answered, according to police.

Rojo allegedly refused to return the iPhone 3GS unless he was paid $40. He offered to meet Barr and exchange the iPhone for the money. Barr contacted the police, who called Rojo and set up a meeting.

When Rojo showed up for the exchange, he was arrested for “his attempt to profit off of the theft of the lost or mislaid property,” which carries two misdemeanor charges.
